General Terms and Conditions

These General Terms and Conditions (the “Terms and Conditions”) apply to all tours, travel arrangements, events, and tour-related services (together, the “Services”) offered, marketed, sold, or organized by all4birding FZ-LLC, a company incorporated in the Ras Al Khaimah Economic Zone (RAKEZ), United Arab Emirates (“all4birding”).

By making a booking, the Participant confirms that they have read, understood, and agreed to be bound by these Terms and Conditions, on their own behalf and, where applicable, on behalf of all individuals included in the booking.

Capitalized terms used in these Terms and Conditions have the meanings given to them in the Definitions and Interpretation clause at the end of this document.

1. Cost and basis of rates

All Tour prices are quoted on a per-person basis, based on double occupancy, unless expressly stated otherwise in the applicable Tour Documentation. A single-occupancy supplement applies where requested or required. Prices are quoted in United States Dollars (USD) or Euros (EUR), as indicated on the all4birding website, the WeTravel booking and payment pages, and the applicable Tour Documentation.

Under normal circumstances, the Tour price is guaranteed at the time of Booking. However, all4birding reserves the right to revise Tour prices if, after Booking, circumstances arise that materially affect the cost structure of the Tour, including but not limited to fuel price increases, currency exchange fluctuations, increases in government taxes or levies, supplier price increases, or other unforeseen cost increases that render the Tour financially unsustainable.

In such cases, any price increase will be communicated transparently and in writing no later than ninety (90) days prior to the scheduled Tour Start Date, together with a clear explanation of the reason for the increase. If the Participant does not accept the revised price, they may cancel the Booking without penalty and receive a refund of Tour Fees paid, excluding any non-refundable third-party costs already incurred.

Unless expressly stated otherwise in the applicable Tour Documentation, Tour prices include accommodation, meals, non-alcoholic beverages, internal ground transportation, guiding services, special access permits, and applicable local taxes. Any included Service that is not used by the Participant for any reason is non-refundable.

Tour prices do not include international airfare to and from the Tour start and end points, personal insurance, passport and visa fees, immigration charges, international departure taxes, excess baggage fees, vaccinations, medical tests or health screening requirements, or personal expenses such as alcoholic beverages, laundry, phone calls, Wi-Fi, or other incidental costs. Optional activities or itinerary components may be offered at additional cost and are clearly identified as such in the applicable Tour Documentation.

Any inclusions and exclusions described in summary form above are provided for general guidance only. The explicit and definitive list of inclusions and exclusions applicable to a specific Tour is the list published in the applicable Tour Documentation. In the event of any discrepancy, the inclusions and exclusions as stated in the Tour Documentation shall prevail and be binding.

2. Reservations and Payments

Deposit amounts, payment schedules, and payment deadlines may vary by Tour. All Tour-specific payment terms are displayed on WeTravel, the third-party booking and payment platform used by all4birding, at the time of Booking and form an integral part of these Terms and Conditions.

All payments for all4birding Tours are processed through WeTravel, which accepts major credit cards and bank transfers. WeTravel acts solely as an independent payment processing platform and is not a contracting party to the Tour. Depending on the payment method selected, WeTravel may apply additional service and/or transaction fees, which are determined solely by WeTravel and disclosed to the Participant at the time of payment. all4birding has no control over, and assumes no responsibility for, such fees.

Receipt of any Deposit or other payment constitutes the Participant’s acknowledgment and acceptance of these Terms and Conditions and the applicable cancellation policy, on their own behalf and on behalf of all Participants included in the Booking. A Booking is accepted and confirmed only once the required payment has been successfully received and processed and written booking confirmation has been issued by all4birding.

If any payment is declined, reversed, disputed, or otherwise not successfully processed, the Booking shall not be considered confirmed, and all4birding shall have no obligation to hold or honor the reservation until payment is successfully completed.

A. Deposit

To confirm a Booking, a Deposit of fifty percent (50%) of the total Tour Fees is required, unless otherwise stated in the applicable Tour Documentation.

B. Final Payment

The remaining balance of the Tour Fees is due no later than ninety (90) days prior to the Tour Start Date, unless otherwise stated in the applicable Tour Documentation. Participants may also elect to pay the full Tour Fees at the time of Booking.

C. Alternative Payment Structures

For certain Tours, Deposit amounts, payment schedules, and payment deadlines may differ from the standard terms set out above. In all cases, the applicable payment terms displayed on the WeTravel booking and payment pages for the relevant Tour shall prevail.

D. Booking Confirmation

A Booking is considered confirmed only once the required payment has been successfully processed and a written booking confirmation has been issued by email by all4birding.

3. Cancellations and Refunds

All Cancellations must be submitted In Writing and will be subject to the cancellation terms set out below. Any refund, where applicable, applies exclusively to Tour Fees paid directly to all4birding and does not apply to ancillary, third-party, or out-of-pocket expenses incurred by the Participant, including but not limited to airfare, rail tickets, insurance premiums, visa or passport fees, taxes, medical expenses, or other personal costs.

If all4birding cancels a Tour, Participants will be notified In Writing, and the applicable refund or rescheduling options relating solely to Tour Fees will be communicated In Writing.

A. Participant Cancellations and Amendments

The Effective Date of Cancellation is the date on which written notice of Cancellation is received by all4birding at info@all4birding.com.

Airline and rail ticket cancellation policies vary by carrier and fare type. Where all4birding has purchased airline or rail tickets on behalf of the Participant, all4birding will use reasonable efforts, without guarantee, to assist in seeking any applicable refund or credit in accordance with the relevant carrier’s rules. Where such tickets or other services have been purchased independently, the Participant is solely responsible for contacting the relevant provider.

Once a Tour has commenced, no refunds are available for any unused Services, accommodation, meals, activities, or other components of the Tour, as such Services are deemed to have been committed or rendered. Under no circumstances are refunds available for ancillary or third-party expenses, whether arranged by all4birding or by the Participant.

Requests for amendments or changes made after payment of the Deposit may, at all4birding’s discretion, be treated as Cancellations and subject to the applicable cancellation fees.

Cancellation fees are calculated as a percentage of the Tour Fees and are intended to reflect administrative costs, supplier commitments, and losses incurred as a result of the Cancellation. Cancellation fees are as follows:

More than ninety (90) days prior to departure: Forfeiture of twenty percent (20%) of Tour Fees, plus any non-refundable third-party costs incurred, and a USD 150 administrative processing fee.
Sixty (60) to eighty-nine (89) days prior to departure:
Forfeiture of thirty percent (30%) of Tour Fees, plus any non-refundable third-party costs incurred, and a USD 150 administrative processing fee.
Thirty-one (31) to fifty-nine (59) days prior to departure:
Forfeiture of fifty percent (50%) of Tour Fees, plus any non-refundable third-party costs incurred, and a USD 150 administrative processing fee.
Thirty (30) days or less prior to departure:
Forfeiture of one hundred percent (100%) of Tour Fees.
B. all4birding Cancellations

all4birding reserves the right to cancel or reschedule a Tour due to a Force Majeure Event, travel restrictions, operational constraints, or insufficient participation.

In the event of such cancellation, any refund or rescheduling offered by all4birding shall apply exclusively to Tour Fees paid directly to all4birding. all4birding shall have no responsibility or liability for ancillary, third-party, or out-of-pocket expenses incurred by the Participant as a result of such cancellation, including but not limited to airline or rail tickets, insurance premiums, visa fees, accommodation booked independently, or other personal costs, regardless of whether such expenses were arranged by all4birding or by the Participant.

Participants are strongly advised to obtain comprehensive Travel Insurance to protect against cancellation, interruption, or other unforeseen events.

4. Passports, Visas, Health Requirements

Participants are solely responsible for ensuring compliance with all passport, visa, entry, exit, and health requirements applicable to their nationality and destination(s), including but not limited to passport validity, visas, transit requirements, vaccinations, medical tests, and entry or exit health screening requirements.

Such requirements are determined by governmental and other competent authorities and may change without notice. Participants are responsible for consulting the relevant official government sources and for obtaining accurate and up-to-date information prior to travel.

While all4birding may, at its discretion, provide general information regarding entry or health requirements, such information is provided for guidance only and does not constitute advice or a guarantee of admissibility. all4birding accepts no liability for denial of entry, refusal of boarding, quarantine measures, or travel disruptions arising from a Participant’s failure to comply with applicable requirements.

5. Travel Insurance

Participants are strongly advised to obtain comprehensive Travel Insurance at the time of Booking, including coverage for medical treatment, emergency evacuation, trip interruption, and trip cancellation, preferably with “cancel for any reason” coverage.

Travel Insurance is the sole responsibility of the Participant and is not included in the Tour Fees. Failure to obtain adequate Travel Insurance does not limit or reduce the Participant’s obligations under these Terms and Conditions, nor does it increase the liability of all4birding in any respect.

6. Health and Fitness

Participants must be in sufficient physical and mental condition to safely undertake the activities and physical requirements of the Tour, as described in the applicable Tour Documentation.

Any medical condition, allergy, disability, medication requirement, or other special requirement that may affect a Participant’s ability to participate in the Tour, or that may require special attention, must be disclosed to all4birding In Writing prior to departure. Failure to disclose relevant information may result in a Participant being unable to participate in part or all of the Tour. Any such disclosure will be treated with the utmost confidentiality under UAE privacy legislation and serves only to ensure the best and safest possible experience for all Participants.

all4birding reserves the right, acting reasonably and in the interest of safety and operational feasibility, to refuse participation or to remove any Participant whose condition or conduct is deemed to pose a risk to themselves, other Participants, guides, or third parties.

In such circumstances, no refund of Tour Fees will be payable, as costs will have been incurred and Services committed.

7. Assumption of Risk

Participation in a Tour involves inherent risks associated with travel and the nature of the Services provided, including but not limited to travel in remote or developing regions, wildlife encounters, transportation by various means, weather conditions, political or civil conditions, and limited or delayed access to medical facilities.

By participating in a Tour, the Participant acknowledges that such risks are an integral part of the Tour experience and, on their own behalf and on behalf of all Participants included in the Booking, knowingly and voluntarily assumes the inherent risks associated with participation in the Tour.

This assumption of risk applies only to risks inherent in the nature of the Tour and does not limit any rights or protections that cannot be excluded under Applicable Law.

8. Force Majeure and Third-Party Services

all4birding acts solely as an organizer of Tours and does not own, operate, or control the services provided by independent Third-Party Service Providers, including but not limited to airlines, accommodation providers, transportation companies, guides, and activity operators. all4birding shall not be liable for the acts, omissions, defaults, or negligence of any such Third-Party Service Providers.

all4birding shall not be responsible or liable for any delay, change, disruption, loss, or failure to perform any obligation under these Terms and Conditions where such delay or failure is caused by a Force Majeure Event or by circumstances beyond its reasonable control, including but not limited to governmental actions or restrictions, weather conditions, labor disputes, mechanical failures, civil unrest, war, terrorism, epidemics or pandemics, or failures of public infrastructure or utilities.

In such circumstances, all4birding shall be entitled to modify, postpone, reschedule, or cancel affected Services or Tours in accordance with these Terms and Conditions, without incurring any liability beyond the refund or rescheduling obligations expressly stated herein.

9. Booking on Behalf of Others

The person making the Booking confirms that they are duly authorized to act on behalf of, and to accept these Terms and Conditions for, all Participants included in the Booking. Acceptance of these Terms and Conditions by the person making the Booking shall be deemed acceptance by each such Participant, and all Participants shall be bound by these Terms and Conditions as if they had individually accepted them.

10. Release and Limitation of Liability

To the maximum extent permitted by Applicable Law, and subject always to any rights or liabilities that cannot be excluded or limited under the laws of the United Arab Emirates, the Participant agrees to release, waive, and hold harmless the Released Parties from and against any and all claims, demands, causes of action, liabilities, losses, damages, costs, or expenses of any nature whatsoever, whether direct or indirect, arising out of or in connection with the Participant’s participation in a Tour.

This release includes, without limitation, claims arising from or relating to personal injury, illness, death, property loss or damage, delay, disruption, inconvenience, evacuation, repatriation, or emotional distress, whether occurring before, during, or after the Tour, including during travel to or from the Tour, participation in optional or ancillary activities, or activities undertaken at the Participant’s own discretion.

The Participant expressly acknowledges that all4birding acts solely as an organizer of Tours and does not own, operate, or control the services provided by independent Third-Party Service Providers. Accordingly, and to the extent permitted by Applicable Law, all4birding shall not be liable for the acts, omissions, defaults, or negligence of any such Third-Party Service Providers, nor for the actions or conduct of other Participants.

To the fullest extent permitted by Applicable Law, the Released Parties shall not be liable for any indirect, incidental, special, or consequential damages, including loss of enjoyment, loss of opportunity, or loss of profit, regardless of the cause.

Nothing in these Terms and Conditions shall exclude or limit liability for death or personal injury resulting from gross negligence or willful misconduct, or for any other liability that cannot lawfully be excluded or limited under Applicable Law.

This release and limitation of liability is binding upon the Participant on their own behalf and, where applicable, on behalf of all Participants included in the Booking, including minors, and shall extend to and bind their heirs, legal representatives, successors, and assigns.

11. Changes to Services

all4birding reserves the right to make reasonable modifications to itineraries, accommodations, transportation, or other Services where such changes are necessary due to operational requirements, safety considerations, Force Majeure Events, or circumstances beyond its reasonable control.

Where reasonably practicable, any material changes will be communicated to Participants, and substitute services or arrangements will be of a comparable standard to those originally planned.

12. Amendments to Terms and Conditions

all4birding may amend these Terms and Conditions from time to time. Any such amendments shall apply only to Bookings made after the effective date of the amendment.

The version of the Terms and Conditions published on the all4birding website at the time a Booking is made shall govern that Booking and shall remain binding for the duration of the Tour.

13. Personal Property

All Personal Property is carried and stored at the Participant’s own risk at all times. all4birding shall not be responsible or liable for the loss of, theft of, or damage to Personal Property, except to the extent required by Applicable Law.

14. Participant Conduct

Participants must conduct themselves in a manner that respects fellow Participants, guides, suppliers, local communities, and applicable local laws, customs, and regulations. Participants must also comply with reasonable instructions issued by all4birding or its appointed representatives during the Tour.

all4birding reserves the right, acting reasonably, to refuse participation or to remove any Participant whose conduct is disruptive, unsafe, unlawful, or otherwise adversely affects the Tour, other Participants, guides, suppliers, or third parties.

In such circumstances, no refund of Tour Fees shall be payable, as Services will have been committed and costs incurred.

15. Disclaimer of Warranties

The Services are provided substantially as described in the applicable Tour Documentation and are subject to the inherent uncertainties and variability of travel, including factors beyond all4birding’s reasonable control.

To the maximum extent permitted by Applicable Law, all express or implied warranties, representations, or conditions not expressly stated in these Terms and Conditions are excluded. Nothing in this clause shall exclude or limit any rights or remedies that cannot lawfully be excluded or limited under Applicable Law.

16. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates and are deemed to have been entered into in the Emirate of Ras Al Khaimah.

Any dispute, controversy, or claim arising out of or in connection with these Terms and Conditions or a Tour shall be subject to the exclusive jurisdiction of the competent courts of the Emirate of Ras Al Khaimah, United Arab Emirates. Where available and appropriate, the Parties may seek to resolve disputes through mediation mechanisms offered within the Ras Al Khaimah Economic Zone (RAKEZ) prior to commencing court proceedings.

Any claim by a Participant must be submitted In Writing to all4birding within sixty (60) days of completion of the Tour to which the claim relates, failing which the claim may be deemed waived to the extent permitted by Applicable Law.

17. Photography and Media

During a Tour, all4birding or its representatives may take photographs, audio recordings, or video recordings of Participants in connection with the Tour and related activities. Unless a Participant notifies all4birding In Writing prior to the Tour that they do not consent, all4birding may use such images or recordings for legitimate promotional, marketing, and informational purposes, without compensation.

Participants retain copyright in any photographs, audio recordings, or video recordings created by them. By sharing such content with all4birding, the Participant grants all4birding a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, and display such content for promotional and informational purposes, without further compensation.

18. Definitions and Interpretation

For the purposes of these Terms and Conditions, the following terms shall have the meanings set out below:

“Administrative Fee” means the non-refundable processing fee charged by all4birding in connection with a Cancellation or amendment, as specified in these Terms and Conditions.

“all4birding” means all4birding FZ-LLC, a limited liability company incorporated in the Ras Al Khaimah Economic Zone (RAKEZ), United Arab Emirates, holding trade license number 47022580, and having its registered office as stated in these Terms and Conditions.

“Applicable Law” means the laws and regulations of the United Arab Emirates as applied in the Ras Al Khaimah Economic Zone (RAKEZ).

“Booking” means the act of reserving a Tour or related Services offered or organized by all4birding through its website, the WeTravel platform, or any other authorized booking channel.

“Cancellation” means a request by the Participant to terminate or amend a confirmed Booking, whether voluntary or involuntary.

“Deposit” means the initial payment required to confirm a Booking, as specified for the relevant Tour.

“Effective Date of Cancellation” means the date on which written notice of Cancellation is received by all4birding.

“Exclusions” means services and costs expressly stated as not included in the Tour price, including but not limited to international airfare, insurance, visas, and personal expenses.

“Final Payment” means the remaining balance of Tour Fees due after payment of the Deposit, payable by the deadline specified for the relevant Tour.

“Force Majeure Event” means any event beyond the reasonable control of all4birding, including but not limited to acts of God, natural disasters, epidemics or pandemics, governmental actions, travel restrictions, war, terrorism, civil unrest, labor disputes, mechanical failures, or failures of public utilities or infrastructure.

“Inclusions” means the services expressly stated as included in the Tour price for a specific Tour, as published in the applicable Tour Documentation.

“Participant” means the person making the Booking and each individual included in that Booking, including minors where applicable, whether named or unnamed at the time of Booking, and any replacement participant accepted by all4birding. The person making the Booking represents that they are authorized to accept these Terms and Conditions on behalf of all Participants included in the Booking.

“Personal Property” means any belongings brought by the Participant on a Tour, including equipment, luggage, documents, and valuables.

“RAKEZ” means the Ras Al Khaimah Economic Zone, United Arab Emirates.

“Release” means the waiver, release, and limitation of liability granted by the Participant in favor of the Released Parties under these Terms and Conditions.

“Released Parties” means all4birding, together with its shareholders, directors, officers, employees, agents, representatives, affiliates, and contractors.

“Services” means the travel-related services expressly included in a Tour as described in the applicable Tour Documentation, which may be subject to modification in accordance with these Terms and Conditions.

“Third-Party Service Provider” means any independent contractor or supplier not under the direct control of all4birding, including but not limited to airlines, accommodation providers, transportation companies, guides, equipment suppliers, and activity operators.

“Tour” means any guided or self-guided travel arrangement, itinerary, event, or experience organized, marketed, or sold by all4birding, whether domestic or international, including any extensions or optional activities.

“Tour Documentation” means the official tour description, itinerary, inclusions and exclusions, and other binding information published on the all4birding website, the WeTravel booking and payment pages, and any written tour materials issued by all4birding for a specific Tour.

“Tour Fees” means the amounts payable by the Participant to all4birding for participation in a Tour, excluding third-party or personal expenses unless expressly stated as included.

“Tour Start Date” means the first calendar day on which the Tour Services commence, as stated in the applicable Tour Documentation.

“Travel Insurance” means an insurance policy obtained by the Participant that may include medical coverage, emergency evacuation, trip interruption, and trip cancellation benefits.

“WeTravel” means the third-party booking and payment platform used by all4birding to process reservations and payments.

“Written” or “In Writing” means communication delivered by email or other durable written form capable of being retained and reproduced.

Interpretation:

References to the singular include the plural and vice versa. Headings are for convenience only and do not affect interpretation. In the event of any inconsistency between these Terms and Conditions and any marketing or promotional materials, the Terms and Conditions and the applicable Tour Documentation shall prevail.
